摘要
作为转变政府职能、优化营商环境的一项创新型举措,告知承诺政策通过在审批理念和审批方式层面的改革,以行政相对人的承诺代替(或暂代)证明材料或行政审批,将监管重心从事前转向事中事后,显著加快了行政审批速度,提高了行政审批效率。告知承诺政策绝非在审批条件、要求、标准层面“降低门槛”,而是“快审”与“严管”并存的有机整体。告知承诺政策执行应当坚持“快审严管”的有效路径,通过优化政策语言、明确放宽审批的快审正解,规范审批流程、切实保障快审的程序正义,重视严管成效、坚决维护快审的结果正义,强化技术服务、助民众积极合理适配快审,努力减少来自行政机关和行政相对人的消极影响,持续升级告知承诺政策执行的质量与水平。
As an innovative measure to transform government functions and optimize the business environment,the notification and commitment policy has significantly accelerated the speed of administrative approval and improved the efficiency of administrative approval through reforms in the level of approval concepts and approval methods by replacing(or temporarily replacing)the certification materials or administrative approval with the commitment of the administrative counterpart,shifting the focus of supervision from ex-event to post-event.It can be seen that the notification and commitment policy is by no means“lowering the threshold”in terms of approval conditions,requirements and standards,but an organic whole that coexists with“fast approval”and“strict management”.Therefore,it is necessary to adhere to the effective path of“fast approval and strict management”in the implementation of the notification and commitment policy,clarify the correct meaning of fast approval by optimizing the language of the policy,standardize the approval process to ensure the procedural justice of the fast approval,pay attention to the effectiveness of strict managementto resolutely maintain the result justice of the fast approval,strengthen the technical services to help the public actively and reasonably adapt to the fast approval,strive to reduce the negative impact from administrative agencies and administrative counterparts,and continue to upgrade the quality and level of the notification and commitment policy implementation.
