个人信息可识别性解释路径的反思与重构 被引量:11

Reflection and Reconstruction on the Interpretation Path of Personal Information Identifiability

摘要 如何理解识别是明确个人信息可识别性的实质问题,既有的解释路径纠结于对个人信息做本质性的客观化理解,难以实现与具体人格权客体和人格要素的区分。将识别置于个人身份建构的动态过程,结合数字经济的现实影响,提供了从社会关系切入,重构个人信息可识别性解释路径的理论启示。作为识别对象的自然人在公共管理关系、社会交往关系与商业消费关系中呈现为公民、社会人与消费者三种角色身份,与之对应的公民身份信息、社会人身份信息和消费者身份信息,分别发挥连接公共管理、自主经营人设和内化消费意愿的功能。公共管理关系中,对公民身份的识别应以公共利益为导向并符合必要原则;社会交往关系中,对社会人身份的识别应以是否新增负面声誉信息为依据;商业消费关系中,对消费者身份的识别应以信息汇集程度是否足以推断消费意愿为标准。 How to understand the identification is the essential issue to clarify the identifiability of personal information.The existing interpretation paths are entangled in the essential objective understanding of personal information, and it is difficult to distinguish it from specific personality rights object and personality elements.Putting identification in the dynamic process of individual’s identity construction, combined with the real impact of the digital economy, provides theoretical inspiration for reconstructing the identifiability interpretation path of personal information from social relations.The natural person as the identification object is presented as a citizen, a social people and a consumer in the relationship of public management, social interaction and commercial consumption.Respectively, the corresponding citizen identity information, social person identity information and consumer identity information play the functions of connecting public management, self-managing personality appearance and internalizing the willingness to consume.In public management relations, the identification of citizenship should be guided by public interests and comply with the necessity principle;in social interactions, the identification of social people should be based on whether negative reputation information is added;in commercial consumption relationships, the identification of consumer identity should be based on whether the degree of information collection is sufficient to infer willingness to consume.
