摘要
个人信息权益究竟属于隐私权的保护范围,抑或是一项独立的权利,在理论上尚存争议。我国在隐私权和个人信息权益的保护模式上经历了从一体化保护到逐渐分离,再到《民法典》对二者进行严格区分的制度变迁。这种严格的区分保护在实践中面临个人信息的私密性检验难题、私密信息与敏感信息的关系难题、非私密信息保护力度的降低问题等。在《个人信息保护法》颁布实施后,应当将隐私权和个人信息保护制度的调整领域分别界定为社会交往关系和个人信息处理关系,突出强调个人信息保护制度在私密信息处理中的优先适用地位,并将作为隐私权保护客体的私密信息限缩为自然人在个人或家庭事务场景中处理的私密信息,以实现隐私权与个人信息保护体系的融合贯通。
There is a theoretical debate as to whether the personal information right and interest falls within the scope of the protection of privacy right or is a separate right.The protection mode of privacy right and personal information right and interest in China has experienced institutional changes from integrated protection to gradual separation, and then to the strict distinction between the two in the Civil Code.In practice, this kind of strict distinguished protection will face the difficulty of privacy test of personal information, the difficulty of handling the relationship between private information and sensitive information, and the problem of reducing the strength of non-private information protection.In the context of the Personal Information Protection Law, the adjustment fields of privacy right and personal information protection system should be defined as social communication relationship and personal information processing relationship respectively, highlighting the priority application of personal information protection system in processing private information, and limiting the private information as the object of privacy right protection to the private information processed by natural persons in the scene of personal or family affairs, so as to realize the integration and coherence of privacy right and personal information protection system.
