摘要
文章以“十四五”时期构建“双循环”新发展格局为背景,结合河北省重点产业发展情况,综合运用文献分析、比较法研究、数据分析、问卷调查和实地调研等方法,探讨贸易调整援助立法路径。研究发现:贸易调整援助立法一方面可平衡自由贸易带来的经济收益与调整成本,以此提高对贸易开放的政治支持度;另一方面可作为他国国内法不当域外适用的反制手段。建议相关立法工作着眼于维护产业安全、落脚于促进产业调整,设计贸易调整援助实体性与程序性内容。研究结论有助企业缓解进口压力、疏通出口堵点,助推国内外双循环良性发展。
In the background of constructing the new development pattern of“dual circulation”during the“14th Five-Year Plan”period and in combination with the development of key industries in Hebei Province,this study explores the path of trade adjustment assistance legislation by comprehensive use of literature analysis,comparative analysis,data analysis,questionnaire surveys,field survey,etc..This study finds that:On the one hand,trade adjustment assistance legislation can balance the economic benefits and adjustment costs brought about by free trade,thereby increasing political support for trade openness;on the other hand,it can act as a countermeasure against improper extraterritorial application of other countries’domestic laws.This study proposes that relevant legislation design the substantive and procedural content of trade adjustment assistance with a view to maintain industrial safety and promoting industrial adjustment.The research conclusions can contribute to alleviation of import pressure and removal of export blockages,thus promoting the“dual circulation”.
