摘要
对国外发达国家和我国地方铁路法规体系建设现状进行了梳理,从落实国家政策要求、适应地方铁路自身快速发展、完善国家铁路法律法规体系方面分析了加快地方铁路法规体系建设的必要性。研究认为,为加快推进完善地方铁路立法,建议地方政府应加快成立铁路立法工作领导小组、加强立法前期调查研究、制定地方铁路立法计划、推动部分规章制度上升为法律法规、大力推进依法行政等。
The development status of local railway legislation of both foreign developed countries and China are reviewed.The necessity of speeding up the improvement of local railway legislation is analyzed from national policy requirement,the needs of local railway development and the improvement of national railway legal system.This paper puts forward suggestions to speed up the improvement of local railway legislation,namely,accelerating the establishment of a leading group for railway legislation,strengthening the preliminary investigation and research of legislation,drawing up a local railway legislation plan,promoting some rules and regulations to become regulations and laws,and strongly promoting administration according to law.
