摘要
党纪处分条例和刑法体例结构相似,遵循“假定条件、行为指示、法律后果”逻辑结构,从旧兼从轻溯及力原则类似,违纪/犯罪构成等理论相通,保障法地位近似。不同的是,两者上位法依据不同,党纪处分条例文本语言更直白,更富有政治色彩,没有规定故意违纪的停止形态,规定了加重处罚但没有专门的附加纪律处分。党纪处分条例为刑法立法提供立法素材,助益刑事司法更好理解裁判的政治效果并推动刑法理论创新;刑法教义学为建构党纪分支学科理论贡献智识,刑法为党纪处分条例完善贡献立法技术和内容的启迪。
The structure of discipline regulations is similar to that of criminal law,which follows the logical structure of“assumed conditions,behavior instructions and legal consequences”.The principle of retroactivity is similar from the old to the lighter.The theories of discipline violation/crime constitution are similar,and the status of safeguard law is similar.The difference is that the basis of the two upper laws are different,and the text language of the Party discipline punishment regulations is more straightforward and more political.It does not stipulate the stop form of intentional violation of discipline,and provides for heavier punishment,but there is no special additional discipline.The regulations on Party discipline and punishment provide legislative materials for criminal law legislation,help criminal justice to better understand the political effect of judgment and promote the innovation of criminal law theory;The dogmatics of criminal law contribute wisdom to the construction of the theory of Party discipline branch discipline,and the criminal law contributes the enlightenment of legislative technology and content to the improvement of the regulations on Party discipline and punishment.
