摘要
《中国共产党纪律处分条例》分则中的“有关规定”是违纪行为的客观方面构成要件。鉴于“有关规定”文义表达的范围过于广泛,基于统一执纪规范依据和提高党纪责任可预期性的考量,应当限定准用性规范的范围。解释立场取决于《中国共产党纪律处分条例》的三重制定目的,“有关规定”条款的准用性规范包括党内法规和省(部)级以上的党内规范性文件,全国人大及其常委会制定的法律和决定,国务院的行政法规、行政措施、决定和命令,部门规章,省级地方性法规和省级政府规章,一定位阶的党政联合发文,以及特定的具有全国性社会公权力的组织制定的、具有全国性效力的主要规章。
The“relevant provision”in the special provisions of regulation of Communist Party of China on disci⁃plinary action is objective constituent element of disciplinary violations.In the view of the scope of the“rele⁃vant provision”is too board and based on the reasons of unifying the normative basis for disciplinary enforce⁃ment and improving the predictability of disciplinary liability,the scope of applicable norms should be limited.The stand of explanation depends on the three-fold purpose of the regulation of Communist Party of China on disciplinary action.The“relevant provision”includes:all the Party rules and regulations and Party normative documents at or above the provincial ministerial level;laws and decisions formulated by the National People’s Congress or the National People’s Congress Standing Committee;administrative measures prescribed in admin⁃istrative ordinance and regulations formulated by the State Council;decisions and decrees the State Council pro⁃mulgated;departmental rules;local regulations and local government rules at the provincial level;documents jointly formulated by the CPC and government at certain hierarchy;major regulations with national validity for⁃mulated by specific organizations with national social public power.
