摘要
我国"轻微罪"立法扩张带来了刑法结构和制度困境,需要进行深入的法理检讨,为"轻微罪"的立法与司法改革确定发展方向。传统理性主义刑法观与积极主义刑法观二者之间寻求适当平衡,既要正视当下社会有效防控非传统重大风险的现实需求,又要考虑如何控制风险刑法过度化,为"轻微罪"立法划定有所为有所不为的边界。针对我国"轻微罪"立法扩张化趋势,需要注意两个方面的问题:一是需要谨慎审视非传统重大风险预防性"轻微罪"立法扩张的正当根据;二是需要深刻检讨传统风险预防性"轻微罪"立法扩张的合理性问题。在确定我国"轻微罪"立法改革发展方向时,应当理性审查"轻微罪"的立法政策,深化改革现行"轻微罪"的司法政策,尽快启动并实现治安拘留的法治化改造。
The legislative expansion of China’s "petty misdemeanors" has brought about dilemmas in the criminal law structure and system, and an in-depth legal review is needed to determine the direction of reform and development for the legislation and judicature in the current and future "petty misdemeanors".A proper balance should be sought between the traditional rationalist view and the current activist view of criminal law.It is necessary to face up to the actual needs of the current society to effectively prevent and control non-traditional major risks, and also to consider how to control the risk of excessive criminal law, delineating the boundaries of what should be done and what should not be done for petty misdemeanors legislation.In view of the expansion trend of petty misdemeanors, firstly, we need to carefully examine the legitimate basis for the legislative expansion of preventive petty misdemeanor of non-traditional major risks, and secondly, we need to deeply review the rationality of preventive petty misdemeanors of traditional risks.When determining the direction of the reform and development of China’s legislation in petty misdemeanors, we should rationally review its legislative policies, deepen the reform of the current judicial policies, and initiate and realize the legalization of public security detention as soon as possible.
