摘要
新时代社会基本矛盾的变化促使以国家治理体系和治理能力现代化为指向的国家治理整体转型,作为国家治理权力体系重要构成的警察权必然彰显与时俱进的治理立场、弘扬治理价值并呈现出鲜明的治理属性。警察权治理属性表现在其不仅仅是孤立的权力设置,而是与社会权利对等并行、深度交互、内在嵌合的,警察权本身内部权力分支之间以及与外部其他国家权力之间形成平衡制约关系,内嵌着决策、执行、监督相互区分又相互协调的权力运行机理。在确立权力监督制约机制的警察权制度架构前提下,还应当在警察权赋权治理、权力分解、权力配置等方面进行制度完善改进。依据结构均衡的要求,完善赋权治理的基础制度规范;遵循权力分解定律,推进警察权决策、执行、监督以及警务事务、警务岗位、警务层级之间的权力合理分解;强化相关制度设计和资源保障,促成分解后的警察权本身内部各权力分支以及权力岗位之间实施有效支持和制约,推动警察权治理结构的优化和治理效能的提升。
The principal contradiction facing Chinese society in the new era has prompted an overall transformation of national governance,aiming at the modernization of the state system and capacity for governance.The police power itself is bound to highlight the governance position,show the governance value and present the distinct governance attribute.This attribute is firstly manifested in that it is not an isolated power setting,but an equal and parallel,mutual interaction and internal integration with social rights,the structure inside and outside the police power and its components also form a balanced and restrictive relationship,and infiltrate the power operation mechanism of decision-making,implementation and supervision distinguishing and coordinating each other.China has initially established the police power system structure of power supervision and restriction,but it still needs to be improved in terms of empowerment governance,power decomposition,power allocation and power restriction.In accordance with the requirements of structural balance,we should improve the basic institutional norms of empowerment governance,follow the law of power decomposition,promote the rational decomposition of police power among decision-making,implementation and supervision,as well as between police affairs,police posts and police levels.Finally,we should strengthen the relevant institutional design and resource guarantee,push the decomposed power parts and power posts to lunch the powerful and effective restriction,and promote the optimization of police power governance structure and the improvement of governance efficiency.
