摘要
互联网平台能够通过算法获取与人之行为密切相关的大量数据,而大型互联网科技平台公司甚至有能力在大数据基础上,提供一种有别于市场治理的数据治理方式。人类正在成为不断向各种网络平台被动提交各种数据的“数据人”,网络平台数据日益激增,事实上使网络虚拟空间获得与公权力相对应的私权力,因此互联网平台数据治理的难题被提上议事日程。其中,如何建立公正的网络平台自我治理体系并重塑网络平台的公共利益职责,如何明确网络平台治理失范的公权力介入机制并消解数据垄断网络平台的非合理结构性优势,如何协同发力确立互联网平台数据的场景化保护并构建互联网平台治理失灵的救济机制,成为网络平台治理中的重点难题。随着网络平台风险的不断增大,唯有通过自我治理、外部治理、协同治理和问责救济等多元化制度创新,不断检视现实困境及其破解方式,综合考量并相互统筹,才能在复杂治理的大背景下,最终达成“私权力”网络平台数据治理与公权力介入机制之间的动态平衡。
Internet platforms can obtain a large amount of data closely related to human behavior through algorithms,and the large Internet technology platform companies can even provide a data governance method different from market governance on the basis of big data.Human beings are becoming "data people" who passively submit all kinds of data to various Internet platforms every day,the data collected by Internet platforms is increasing rapidly,which in fact makes the Internet virtual space obtain the private power corresponding to the public power.Therefore,problems with Internet platform data governance have been put on the agenda.Among them,the key ones include how to establish a fair Internet platform self-governance system and reshape the public interest responsibility of the Internet platforms,how to clarify the public power intervention mechanism in case of Internet platform governance anomie and reduce the unreasonable structural advantages of the platforms in data monopoly,and how to cooperate to establish the scenario protection of Internet platform data and build a relief mechanism for Internet platform governance failure.With the increasing risk of Internet platform,only by making diversified institutional innovations such as self-governance,external governance,collaborative governance and accountability and relief,constantly examining the practical difficulties and their solutions,and taking an integrated approach,can we finally achieve a dynamic balance between the data governance of the Internet platforms as the "private power" and the public power intervention mechanism under the background of complex governance.
