摘要
农村集体经济组织的内涵与外延界定是农村集体经济组织法立法的前置性问题。学理界定尚未形成共识,学理界定与法律界定的表达方式不同,但是,前者可以为后者提供理论支撑。国家层面立法存在明显缺失,政策表达、地方立法和改革实践可为法律界定提供借鉴与支撑。法律规范中的农村集体经济组织的内涵,应表达为“以乡(镇)、村、组生产资料集体所有制为基础建立的合作经营、民主管理、服务成员的社区性合作经济组织”。农村集体经济组织外延的立法表达,宜采纳“正面列举+反面排除”的综合表达模式。城市建成区范围内的“农村”集体经济组织可以参照适用农村集体经济组织法的有关规定。
The definition of the connotation and extension of the rural collective economic Organizations is the basic issue of the legislation of the rural collective economic Organizations law.The academic definition has not yet reached a consensus.The expression of academic definition is different from that of legal definition.However,the former can provide theoretical support for the latter.There are obvious deficiencies in national legislation,but policy expression,local legislation and reform practice can provide reference and support for legal definition.The connotation of rural collective economic Organizations in legal norms should be expressed as“community cooperative economic Organizations based on collective ownership of means of production of townships(towns),villages and groups,with cooperative operation,democratic management and serving members”.The legislative expression of the extension of rural collective economic organizations should adopt the comprehensive expression mode of“positive listing+negative exclusion”.The“rural”collective economic organizations within the urban built-up areas can refer to the relevant provisions of the“rural collective economic Organizations law”.
