摘要
作为国家治理体系的重要组成部分,农村集体经济组织的治理体系亟待完善。农村集体经济组织治理面临法律规范不健全、产权制度不清、村委会过度干预、治理体系不完善等问题,根源于农村集体经济组织职能定位的双重性及集体所有法权关系的复杂性。农村集体经济组织治理应在分类改革路径下,逐渐剥离公共服务职能,确立营利性为主的市场主体地位。基于公有产权形态,明确农民集体和集体经济组织间信托法律关系,继而完善其授权经营机制。在此基础上,搭建治理结构、构建治理机制,以适用集体经济治理现代化的改革需求。
As an important part of the national governance system,the governance system of rural collective economic organizations needs to be improved urgently.Governance of rural collective economic organizations faces problems,such as unclear subject positioning,unclear property rights structure and inadequate governance systems,which are rooted in the complexity of functional positioning and legal rights.Rural collective economic organizations should divest their public service functions under the path of classification reform,establish their market dominance as for-profit legal persons.Based on public ownership,clarifying the trust legal relationship between farmers'collectives and collective economic organizations,and then improving their authorized operating mechanism.On this basis,the governance structure and governance mechanism were established to meet the reform needs of the modernization of the collective economic governance system.
