摘要
夫妻忠诚协议是指男女双方在婚前或婚后达成的、建立在夫妻忠诚义务基础之上的、由一方在违反约定的忠实义务时所承担一定责任的协议。在民法典婚姻家庭编及其司法解释(一)对夫妻忠诚协议的法律效力仍未作出明确回应的背景下,通过民法典合同编第464条对身份关系协议的接纳,赋予夫妻忠诚协议中关于财产责任的约定参照适用合同编的法律效力,有利于加强婚姻关系中无过错方的利益保护,并最终促进民法典婚姻家庭编第1043条所提倡的平等、和睦、文明的婚姻家庭关系的建立。
The couple loyalty agreement is an agreement reached by both parties before or after marriage on the basis of husband-and-wife loyalty obligation,by which one party when violating the agreed loyalty obligation has to undertake certain responsibilities.Under the background that the civil code of marriage and family section and its judicial interpretation(1)still have no rules about the legal effect of the couple loyalty agreement,we can use the article 464 of the civil code of the contract to adjust the stipulation about the property liability in loyalty agreement,which is conducive to strengthening the protection of the interests of the no-fault party in the marital relationship and eventually establishing a harmonious and civilized marriage and family relations just as expected in the article 1043 of the civil code of marriage and family section.
