摘要
新婚姻法第4条规定“夫妻应当相互忠实”，完成了将夫妻问的忠实义务从道德入法律的升华。新婚姻法第四十六条规定的要求请求离婚损害赔偿的事由范围偏窄，应作目的性扩张解释使之更符合婚姻法的立法精神；加之婚姻本质上即为包含特定人身关系的契约，而婚姻法中也不应缺乏对契约观的恰当移植，因此上海市闵行区法院对全国首例夫妻间忠诚协议所做的判决，无论在法律上还是法理上均应予以肯定。
The No. 4 item in the new marriage law, which stipulates ' Husband and wife should be loyal to each other', completes the sublimation of faith duty between husband and wife from morality to law, however, the No. 46 item narrows down the scope for the compensation for the damages in divorce. It should be explained further in order to meet the legislative spirit of marriage law. In addition, because the essence of marriage is a contract containing special personal relationship, the marriage law cannot deny the proper transplant of the idea of contract. Therefore, the judgment passed by Min Huang District People's Court in Shanghai on the first case of loyalty agreement between husband and wife in China should be affirmed on the basis of law and legal principle.
