摘要
"接近正义"是国际体育仲裁机制建立、运作和发展的重要理论支撑。基于国际体育组织有义务为运动员提供财政支持、国际体育仲裁结果严重影响运动员的基本权利、国际体育仲裁上诉仲裁免费规则范围进一步限缩等原因,国际体育仲裁院依据接近正义的4个原则:获得裁判的权利、接触律师的权利、获得资助的权利以及若干合理的限制来构建其法律援助制度。国际体育仲裁应扩大法律援助申请人的资助范围、放宽法律援助申请条件的限制、放松公益律师的遴选限制、缩短法律援助决定的期限、明确不再支付补充预缴费用和协调与其他国际体育组织的规定。我国正在建立中的体育仲裁制度应当吸收借鉴CAS法律援助的经验,建立我国体育仲裁法律援助制度,构建我国体育公共法律服务体系,提高我国体育法律服务质量,以保障我国运动员切实享有"接近正义"的权利。
"Access to Justice"is an important theoretical basis for establishing,running and developing the mechanism for international sports arbitration.International sports organizations are obliged to provide athletes with financial support,the results of CAS(the Court of Arbitration for Sports)arbitration seriously affect the fundamental rights of athletes,and the scope of the"free of charge"rule for CAS appeals procedure has been further limited,so the CAS builds its legal aid system based on four principles of access to justice:the right to access arbitration,the right to access a lawyer,the right to receive funding,and some reasonable restrictions.The CAS should expand the scope of funding for legal aid applicants,relax restrictions on legal aid application conditions,relax restrictions on the selection of"pro bono"counsel,shorten the time limit for legal aid decisions,make it clear that recipients of legal aid are no longer responsible for paying supplementary advance costs,and coordinate with other international sports governing bodies.China’s sports arbitration should draw on the experience of the CAS legal aid system,establish a legal aid system and a public legal service system for sports,and improve the quality of sports legal services to ensure that our athletes have actual"Access to Justic".
