摘要
举报投诉查处是卫生监督工作的重要职责之一。本文以一卫生监督举报投诉的案例查处为例,分析举报投诉与行政处罚的关系,讨论举报投诉中规章以下规范性文件的效力认定,并就如何规范处理,合理规避履职风险提出了建议。
Investigating and dealing with complaints is one of the important duties of health supervision.This paper took a report and complaint in the health supervision as an example,analyzing the relationship between report and complaint and administrative penalty,discussing the determination of the validity of the regulatory documents with lower level than rules and regulations in the reports and complaints,and putting forward the suggestions on how to handle the report and complaint in compliance with standards and to avoid the performance risk in a reasonable way.
