摘要
本文以运用大数据分析卫生行政执法的刑事法律风险,为卫生行政执法的风险防控工作提供参考依据为目的,重点研究2007-2016年全国卫生行政执法人员渎职犯罪判例,运用法律统计的方法,对选取的109个案例提取裁判要点进行了统计分析和归纳。最终得出结论——近十年来卫生行政执法领域的渎职罪案件数量大幅攀升,法律风险分析与防控工作应予重视,应尽快组建公职律师团队,建立起刑事法律风险防控机制。
The objective was to provide a reference of criminal law risk prevention and control work for health law enforcement in the way of using big data analysis. The health law enforcement personnel malfeasance crime cases from 2007 to 2016 nationwide were choosed as research object. 109 cases of extraction referee points were sum- marized and statistical analyzed using the method of statistical law. The results showed that malpractice cases num ber soared in the field of health law enforcement in recent decade, Legal risk analysis and prevention and control should be seriously paid attention. A public legal team should be formed as soon as possible. And risk prevention and control mechanism of criminal law should be established.
