摘要
技术与制度存在内在关联,制度对于促进和保障技术发展具有重要价值。无人驾驶技术和产业的发展环境,在"技术—制度"的分析框架下,主要包括技术环境和制度环境。目前制度环境方面存在着"重政策轻法律"的问题。因此,应基于无人驾驶领域的特殊性,填补相关立法领域存在的空白;同时,以"安全与发展"两类价值作为权衡与引领的标准,加强对重点领域的法律规制,处理好政策与法律、政府与市场、技术与制度等多重关系,从而持续优化无人驾驶的制度环境。这对于信息化、网络化、数字化、智能化发展所涉及的诸多领域亦具有普遍意义,尤其有助于推动"发展导向型"法治的构建,促进"信息法学"和"发展法学"的发展。
There is an internal relationship between technology and institution,and institution is of great value to promoting and guaranteeing the development of technology.With the"technology—system"analysis framework,the development environment of the driverless technology and industry mainly includes the technological environment and the institutional environment.At present,there is a problem of"the policy prevails over the law"in regard to the institutional environment.Therefore,based on the particularity of driverless driving,we should fill in the gaps in the relevant legislative field.At the same time,we should take the"safety and development"values as the standard for evaluating and guiding,strengthen the legal regulation of key areas,and properly deal with the multiple relationships between policy and law,government and market,and technology and system,so as to continuously optimize the institutional environment of driverless driving.This is also applicable to the many areas involved in promoting IT-based,Internet-fueled,digitalized and intelligent development.In particular,it helps to improve the"development-oriented"rule of law and enhance the disciplines of"information law"and"development law".
