摘要
在市场化、信息化、法治化“三化”融合发展的背景下,探讨与其相应的经济发展、网络安全与经济法规制的“三者关系”甚为必要。为此,本文力图在“安全—发展”的分析框架下,揭示网络安全对经济发展的重要影响,以及兼顾安全与发展的重要价值;同时,还应在“技术—制度”的分析框架下,解释网络安全与经济法规制的内在关联,分析相关经济法规范在专门立法与非专门立法中的功能侧重,从而说明网络安全法不仅是网络法、安全法,也是规制法或监管法,进而揭示立法机关将其归入经济法的理据。上述两类分析框架有助于形成对“三者关系”的系统认识,从而有助于全面推进网络安全法治建设,并深化发展法学、信息法学和经济法学的交叉研究。
In the context of the integration of marketization,informatization,and legalization,it is necessary to explore the“three-part relationship”with the corresponding economic development,cyber-security,and regulations by economic law.To this end,it is necessary to reveal the important impact of cyber security on economic development and the important value of balancing security and development under the“securitydevelopment”analysis framework.At the same time,it should also be explained under the“technologyinstitution”analysis framework that the internal relationship between cyber security and regulations by economic law,and analyze the functional focus of relevant economic law norms in specialized and non-specialized legislation,so as to explain that the cyber security law is not only a mere cyber law or security law,but also a regulatory or supervisory law,and further to suggest that it should be included in economic law by legislature.Based on the above two types of analysis frameworks,a more systematic understanding of the“three-part relationship”can be formed,which will help comprehensively promote the construction of the rule of law in cyber-security,and deepen the interdisciplinary research of law,information law and economic law.
