摘要
在新中国成立70周年这一历史时刻需要对中国法治建设进行全面梳理和总结,是中国在当前新时代所面临的新阶段、新环境、新矛盾、新使命所决定的。仅就新中国成立70周年而言,可以将其发展历程归结为改革开放前30年和改革开放后40年两个大的历史阶段。前者又可分为新中国的法治初创及新中国法治建设的曲折阶段;后者则可分为中国特色社会主义法治形成、中国特色社会主义法治发展与完善、中国特色社会主义法治建设新时代几个阶段。回顾过去70年,新中国法治建设实践取得了前所未有的伟大成就,主要体现在:对法治认识和把握日趋深入,形成了中国特色社会主义法治观;从无到有、从量到质、从静态到动态,从中国特色社会主义法律体系到中国特色社会主义法治体系建设稳步推进;从依法行政到法治政府建设有序推进;司法改革持续推进,司法为民理念得到贯彻落实;普法工作得以持续进行,全民守法意识得到加强;法学研究取得丰硕成果,为法治建设提供有力支撑,形成了具有中国特色的法治话语体系,全球对话能力得到显著增强。新中国70年的法治建设历程中取得如此成就,需要认真总结宝贵经验:一是坚持党对法治建设的全面领导;二是坚持良法善治;三是坚持实事求是;四是坚持开放包容;五是坚持中国本色。展望中国法治建设之未来,我们应当更加坚定地坚持党的领导,以更加包容开放的姿态,进一步重视卓越法治人才培养和法学教育发展,全面建成以世界水准法治理论为引领,法治政府、法治社会、法治国家三位一体的现代法治国家。
At the historical moment of the 70 th anniversary of the founding of New China,it is necessary to comprehensively review and summarize China’s rule of law construction,which is determined by the new stage,new environment,new contradictions,and new mission facing China in the current new era.In terms of the 70 years since the founding of New China,its development process can be attributed to two major historical stages:30 years before reform and opening up and 40 years after reform and opening up.The former can be divided into the beginning of the rule of law in New China and the tortuous phase of the construction of the rule of law in the new China;the latter can be divided into the formation of the socialist rule of law with Chinese characteristics,the development and improvement of the rule of law in socialism with Chinese characteristics,and the new era of the construction of the rule of law in socialism with Chinese characteristics stage.Looking back over the past 70 years,the practice of rule of law construction in New China has achieved unprecedented great achievements,mainly reflected in:deepening understanding and grasp of the rule of law,forming a socialist concept of rule of law with Chinese characteristics;from nothing,from quantity to quality,from static To the dynamic,the construction of the socialist legal system with Chinese characteristics to the socialist legal system with Chinese characteristics has been steadily progressing;from the administration according to law to the construction of the government under the rule of law in an orderly manner;judicial reform continues to advance,and the concept of justice for the people has been implemented;The law-abiding awareness of the whole people has been strengthened;the legal research has achieved fruitful results,provided strong support for the construction of the rule of law,formed a discourse system of the rule of law with Chinese characteristics,and the global dialogue ability has been significantly enhanced.Such achievements in the course of rul
