环境行政命令与环境行政处罚的错位与匡正——界分基准与功能定位的视角被引量：9

摘要环境行政命令与环境行政处罚是两种相互独立又关联的行政决定行为。独立性决定二者的边界关系应是清晰明了的,即通过内容的惩罚性(核心)+形式的意思性(补充)+结构的保障性(辅助)的基本模式加以界分,并从解释论与立法论双重路径解决环境行政命令与环境行政处罚的模糊地带——责令性行政行为立法概念不清、性质难辨之难题。关联性旨在二者衔接关系应是具有先后次序性,即环境行政命令在二者衔接关系中具有优先适用性,处于基础性、主导地位,这是由环境行政命令与环境行政处罚的基础性与保障性行政行为性质界分及其功能定位所决定的。在此基础上,二者衔接关系之未来立法应以前置条件的关系为基础规范结构,其他规范结构的设计则应考虑违法情节、功能定位、适用条件等因素以解决现行法律规范中衔接关系不合理之困境。 Environmental administrative orders and environmental administrative penalties are two kinds of administrative decisions that are both independent and related to each other. Independence determines that the boundary between the two should be clearly demarcated through the content of the punitive (core) + form of meaning (supplement) + structure of the support (assistance) model.Interpretation and legislation should be taken as the dual path to tackle the ambiguous zones between environmental administrative orders and environmental administrative penalties, that is, the unclear legislative connotation and nature of the ordered administrative action.Relevance means that among the two cohesive factors, the environmental administrative order should be given priority as it remains in the foundational and dominant position in case of application as compared to the function and nature of environmental administrative penalties. On this basis, the future legislation of the convergence should take the prerequisite relationship as the basic normative structure. The design of other normative structures should consider such factors as illegal circumstances, functional orientation and applicable conditions,in order to resolve the problem of unjustified cohesive relationship in the existing legal norms.
