摘要
科技型小微企业具有强烈的通过自主知识产权尤其是专利权发展壮大之动机,但与重视创新相对应的是,科技型小微企业在专利运营过程的实施、转让许可与变现三个阶段中存在着从属专利侵权、专利检索不当、技术秘密泄露等各项风险。基于此,制定专利运营战略、积极借助外部力量、合理取舍专利技术、主动购买专利保险等措施是提高企业风险防控、提高专利技术含量的有效防控策略。
Technology-based small and micro enterprises have strong motives for the development of independent intellectual property rights,especially patent rights.However,corresponding to the emphasis on innovation,technology-base small and micro enterprises have various risks such as subordinate patent infringement,improper patent retrieval,and disclosure of technical secrets in the three stages of patent operation implementation,transfer license and realization.In this context,the formulation of patent operation strategy,rational selection of patented technology,purchase of patent insurance and other measures are needed to prevent the risk and control of enterprises and the content of patented technology.
