摘要
志愿服务记录是保障志愿者权益、管理整个志愿服务的关键环节,而志愿服务记录主体的范围则是志愿服务记录制度最为重要的问题。《志愿服务记录办法》(2012)规定的记录主体与《中华人民共和国慈善法》和《志愿服务条例》存在冲突,与“全国志愿服务信息系统”的实践也不一致,因此亟待制定新的法律规则对之加以明确。依据《志愿服务条例》,新规则应明确规定志愿服务的记录主体为志愿服务运用单位,具体包括志愿服务组织和其他开展志愿服务的党政机关、企事业单位和社会组织等。制度实践层面,在各地已普遍使用“全国志愿服务信息系统”的情况下,应根据新规则明确在该系统注册的记录主体,完善该系统的运行机制。
Record of voluntary service is the key link of protecting volunteer’s rights and managing voluntary service.The record subject is the most important issue.There are conflicts between Voluntary Service Recording Scheme and Charity Law,Voluntary Service Ordinance.However,it is not in accord with practice.So it is necessary to reorganize the rules of voluntary service record.According to Voluntary Service Ordinance,the record subject should be the units of organizing voluntary service,including voluntary service organizations,the party organs,administrative organizations,enterprise,public institutions,and social organizations.In practice,we are using China volunteer System universally.People may need to regulate the record subjects registering in this system according to the new rules and perfecting the operation of this system.
