摘要
公示作为物权法的一项原则,主要适用于以法律行为方式发生的物权变动和处分非以法律行为方式取得的不动产物权的情形,目的是节约交易成本、便捷交易并降低交易风险。公示实质上是学者对可作为裁判基准的物权变动公示规范予以学说构成的产物,其适用范围的有限性决定了不能把它当作一种抽象、概括的法律原则予以规定,而应立足于具有明确适用条件和法律效果的法律规则予以规定。《物权法》在表达公示原则上采取了'原则规定——一般规定——特别规定或者具体规定'的三层规范结构体系。民法典物权编在表达公示原则时,不应沿袭《物权法》叠床架屋的繁琐规范模式,以'一般规定——特别规定'的规范模式即可充分将公示原则表达清楚。
The real right should be publicized,which is regarded as a basic principle of the property law.The publicity principle is mainly applicable to the change of real rights by juristic act and the disposition of real property rights which are not acquired by juristic act.Its purpose is to save transaction cost,facilitate transaction and reduce transaction risk.Publicity is essentially the product of doctrine on publicity norms of real right changes that can be used as the basis of judgment.The limitation of its scope of application determines that it can not be seen as an abstract and general legal principle,but should be stipulated as a legal rule with clear applicable conditions and legal effects.Property Law of the People’s Republic of China adopts a three-level normative structure of'principle provisiongeneral provisionspecial provision or specific provision'in expressing the principle of publicity.In expressing the publicity principle,the property law of the Civil Code should not follow the complicated normative model of the Property Law of the People’s Republic of China.The publicity principle can be fully expressed by the normative model of'general provisionsspecial provisions'.
