负责监督《公民及政治权利国际公约》的人权事务委员会迄今共通过了36项一般性意见,其中的一些解释得到了缔约国的承认和援引,另一些解释则引发了缔约国的批评。一般性意见有助于形成缔约国理解《公约》的共识。一般性意见的某些解释还得到国际法院以及国际法委员会的采纳。一般性意见可引起《维也纳条约法公约》第31条第3款所称的嗣后协定和嗣后惯例,也可引发或反映《维也纳条约法公约》第32条所称的嗣后实践。一般性意见具有类似《国际法院规约》第38条第1款(卯)项所称之辅助资料的作用。
To date, the Human Rights Committee, which is responsible for monitoring the International Covenant on Civil and Political Rights, has adopted 36 General Comments. Some parts of the General Comments of the Human Rights Committee are accepted or invoked by the State Parities to the International Covenant on Civil and Political Rights, while other parts provoke criticism from them. The General Comments contribute to the formation of common understandings on the Covenant among the State Parties. In addition, some interpretations of General Comments are adopted by the International Court of Justice and the International Law Commission. General Comments may give rise to subsequent agreement or subsequent practice by parties under Article 31 (3), they may also give rise or refer to other subsequent practice under Article 32 of the Vienna Convention on the Law of Treaties. General Comments serve as supplementary means for the determination of rules of law under Article 38 (1)(d) of the Statute of International Court of Justice.
