摘要
我国人口老龄化严重,老年人对医疗辅助的需求增加,"医养结合"模式成为新时代的养老趋势。虽然"医养结合"模式的实行极大地提高了老年人的养老质量,但是其实行过程中老年人权益未能得到有效保障。从法律规制视角而言,当前"医养结合"模式下老年人权益保障主要存在立法有缺陷、执法不规范、司法救济乏力、普法宣传不当等问题,需完善相关立法、深化执法规范建设、强化司法保障、改善普法宣传效果,以切实保障老年人权益。
The aging of population is escalating in China, the demand for medical assistance among the elderly has increased, and the “combination of medical care and nursing” model has become the trend of elderly care in the new era. Although the implementation of the “combination of medical care and nursing” model has greatly improved the quality of elderly care, the rights and interests of the elderly have not been effectively protected during its implementation. From the perspective of legal regulations, the protection of the rights and interests of the elderly under the current “combination of medical care and nursing” mode has such major problems as legislative defects, irregular law enforcement, lack of judicial relief, improper publicity of law popularization, etc. It is necessary to improve relevant legislation, deepen the construction of law enforcement norms, strengthen judicial protection, and improve the publicity effect of law popularization in order to effectively protect the rights and interests of the elderly.
