摘要
教育立法存在两种不同的思维和方式,即权力的思维和方式、权利的思维和方式。国家治理现代化意味着,立法工作中的权力思维和方式要向权利思维和方式转变。按照后一种思维和方式,学前教育立法应当把学龄前儿童权利作为学前教育社会关系的主要和决定性方面而进行制度安排,把最有利于保障学龄前儿童权利作为根本宗旨,根据保障学龄前儿童权利的需要来配置其他主体的权力、权利和义务。同时,把这一思维和方式运用在立法过程中,注意倾听最弱势阶层的家庭及学龄前儿童的意见和建议。
There are two different ways of thinking in legislative work,which are the thinking and way of power and the thinking and way of right.The modernization of state governance means that the thinking and way of power in legislation should be changed to the thinking and way of right.According to the latter way of thinking,the legislation of preschool education should take the protection of children’s rights as the priority value goal and the rights of preschool children as the main and decisive aspect of social relations in preschool education.The rights of preschool children determine the rights,powers and obligations of other subjects.Also,legislators should pay attention to the opinions and suggestions of most vulnerable groups of families and preschool children.
