摘要
"一带一路"倡议的愿景之一是积极探索全球治理新模式,特别是国际法治建设和发展。三年来,我国在商事争端解决机制设立和法治合作等方面已经有了初步设想和进展,可以在投资争端等方面进一步完善,但是在贸易和投资规则的方面,仍然没有相应的设计。我国应该以TPP文本为参考,及时提出相应倡议,包括比WTO规则标准更高和更为全面的贸易规则以及统一的投资规则。
One of the objectives of the Belt and Road Initiative is to seek new models of international cooperation and global governance. In the past three years,the endeavors to establish settlement system for commercial disputes and cooperate on rule of law aspects have made positive progress,although further plans such as ISDS need to be taken. However,there is still not plan for substantial rules of trade and investment. It’s time for China to initiate this plan based on the text of TPP including updated trade rules from the WTO and integrated investment rules.
