摘要
党的二十大报告提出了科学化、系统化的中国式现代化理论,法治现代化既是中国式现代化的组成部分,也是中国式现代化的有力保障。在法治轨道上全面建设社会主义现代化国家需要关注民商事纠纷的解决。社会与国家的分离与博弈促成了纠纷的多元化解决机制,全球化则加速了多元化纠纷解决机制的发展与变革,与中国式现代化的要求相呼应。面对百年未有之大变局下解纷体系的调整,民商事纠纷多元化解决机制的完善应满足国家治理体系现代化和推进高水平对外开放的时代需求。我国应在厘定目标的基础上,通过调配立法与司法资源,完成民商事纠纷多元化解决的顶层设计,以增强诉讼在民商事纠纷解决中的引领力;同时也要继续贯彻落实把非诉讼纠纷解决机制挺在前面的要求,提高仲裁的公信力和发挥调解的聚合力,从而服务和保障中国式现代化的建设。
The report of the 20th National Congress of the Communist Party of China has proposed a scientific and systemic theory on Chinese modernization.The modernization of rule of law is an integral part to and a strong guarantee of Chinese modernization.The construction of China into a modern socialist state according to law needs to focus on the civil and commercial dispute resolution.The separation of society from state and their conflicts have contributed to the alternative dispute resolution mechanism,and globalization also speeds up its development and transformation,which also meets the demands of Chinese path to modernization.In the face of the adjustment of the dispute resolution system under the unprecedented change of the century,the improvement of the diversified civil and commercial dispute resolution mechanism should meet the times needs of modernizing the national governance system and promoting high-level opening up.China should allocate the legislative and judicial resources on the basis of setting the goals,and complete the top-level design of the mechanism to strengthen the leading role of litigation in resolving civil and commercial disputes.The instruction to put alternative dispute resolution mechanisms in the front line should also be continued,the credibility of arbitration should be improved,and the cohesion of mediation should be exercised so as to serve and safeguard the Chinese modernization.
