摘要
我国经济社会发展进入新时代,社会变革和互联网技术的叠加效应给人类生活带来了翻天覆地的新变化。各种矛盾纠纷不断涌现,网络平台领域发生的纠纷也呈现出快速多元增长趋势。传统的纠纷处理模式难以解决网络平台日益增多的矛盾纠纷,网络平台线上多元解纷模式应运而生,它的理念和做法与生俱来地将传统的基因糅合于现代的互联网高新技术之中。然而网络平台线上多元解纷模式面临信任不足、居中裁判偏离和解纷规则不完善等挑战,因此,需要构建与完善网络平台线上多元解纷信用机制、纠偏机制、内生机制、外衔机制和规则制定机制,以此推动网络平台线上多元解纷模式的日臻完善。
China's economic and social development has entered a new era,and the combined effect of social transformation and Internet technology has brought earth-breaking new changes to human life.Various conflicts and disputes continue to emerge,and disputes in the field of online platforms also show a trend of rapid and diversified growth.The traditional dispute settlement mode is difficult to solve the increasing number of disputes on the network platform,so the online multiple dispute resolution mode of the network platform has emerged.Its concept and practice are born to blend the traditional genes into the modern high-tech Internet.The online multiple dispute resolution mode is faced with challenges,such as lack of trust,the deviation of the referee and imperfect rules of dispute resolution.Therefore,it is necessary to build and improve the credit mechanism,deviation correction mechanism,endogenous mechanism,external cohesion mechanism and rule-making mechanism of online multiple dispute resolution,so as to promote the perfection of the online multiple dispute resolution mode.
