摘要
如何评价网络服务提供行为,是当下司法实践面临的重要问题。网络服务提供行为往往具有业务的正当性,与仅仅对法益具有负面价值的犯罪行为有很大差别。因此,关于网络服务提供行为的中立性判断是其刑法评价的关键点。实务界和理论界往往将行为人的主观因素作为其网络服务中立性的判断标准。但是,这种观点忽略了法益侵害性的客观本质,容易不当地扩大处罚范围。因此,中立性的判断不能以主观要素作为判断核心,而应根据网络行为对社会生活的重要性、对技术创新的推动性以及行为人对其网络服务的负面价值的可回避性等客观因素进行考察。在快播案中,行为的P2P经营行为已经偏离了业务的正当性,法院对其以传播淫秽物品牟利罪进行认定,是合理的。
How to evaluate the provision behavior of netw ork service is an important issue in the current judicial practice. Netw ork service provision behavior often has the legitimacy of business and is quite different from the criminal behavior w hich only brings a negative value to the law. Therefore,the neutral judgment about the provision behavior of netw ork service is the key point of its criminal evaluation. The practical and theoretical circles often regard the subjective factors of the actor as the criteria for judging the neutrality of their netw ork services. How ever,this view ignores the objective nature of the legal interest violation and is easy to improperly expand the scope of punishment. Thus,the judgment of neutrality can not be judged by the subjective factor as the core,but should be based on the importance of the netw ork behavior to the social life,the promotion of technological innovation and the avoidance of the negative value of the actor＇s behavior. In the Qvod＇s case,the behavior of the p2 p business behavior has deviated from the legitimacy of the business,and the court＇s judgement of its dissemination of pornographic material for the crime of profit is reasonable.
