机动车强制保险赔付限额制度之反思与重构 被引量:4

The Reflection on and Reconstruction of the Liability Cap of the Compulsory Motor Vehicle Insurance

摘要 机动车强制保险的立法目的在于为交通事故受害人提供基本保障,然《交强险条例》、《交强险条款》所确立起的事故限额、分项限额、责任区分限额等赔付限额制度难以实现这一立法目的。不仅如此,现行赔付限额制度在受害人救济方面存在严重失衡,轻伤害受害人可以获得完全赔偿,而重伤害受害人却得不到基本保障。我国机动车强制保险赔付制度应当借鉴工伤保险的有益经验,在重新厘定保险赔付范围的基础上,针对不同程度的伤害设置不同的赔付标准,进而实现为交通事故受害人提供基本保障之立法目的。 The legislative purpose of compulsory motor vehicle insurance is to provide basic protection to automo- bile-accident victims. However, the Regulation on Compulsory Traffic Accident Liability Insurance for Motor Vehi- cles and the Terms of Compulsory Traffic Accident Liability Insurance for Motor Vehicles have prescribed liability limits per accident, classified limits and benefit limits per liability, which failed to achieve the goal of the legisla- tion. Furthermore, the current payment system is seriously imbalanced in terms of victim relief. The victims who suf- fer light damages can get full compensation, while the victims who suffer heavy damages cannot get even basic pro- tection. The legislator should draw on the experience of work-related injury compensation system, readjusting the scope of payment and setting different payment standards for different levels of damages, thus fulfilling the legislative objective.
