摘要
宪法解释程序是平衡宪法价值与事实、宪法原则与社会现实的重要纽带,也是控制解释权滥用的重要保障。宪法解释中各种利益关系的平衡依托于有效的宪法解释程序。通过吸纳和对比各国的历史传统和宪法体制,可以看出,宪法解释程序的价值体现在国家整合、凝聚社会主流价值观、宪法价值的具体化、限制解释权滥用、宪法学原理本土化等功能上。基于此,健全中国宪法解释程序机制,完善全国人大及其常委会宪法监督制度,加快制定《宪法解释程序法》,使宪法解释具有可操作性,是中国全面推进依宪治国、依宪执政的重要任务和使命。
The constitution interpretation procedure functions as an important bond both balancing the constitution value and facts and connecting the constitution principles and social reality,and also as a guarantee to regulate interpretation pow er abusing.The balance of various interests in constitution interpretation is achieved through a valid procedure.The value of the procedure,through absorbing and comparing the historical traditions and constitution systems of various countries,is presented in the diverse functions of it:integrating nation,advocating the social mainstream values,embodying constitution values,preventing interpretation abusing and localizing constitution theories.Therefore to realize the further promotion of constitution-based governance and ruling,it is a significant mission to improve the mechanism of Chinese constitutional interpretation procedure,to enhance the NPC supervision system and to lay dow n the law of constitution interpretation procedure,thus making constitution interpretation more operable.
