摘要
完善宪法解释启动机制是健全宪法解释程序机制的重要问题。"人民当家作主"理论是从我国实际出发探索启动宪法解释程序的理论基础;人民代表大会制度是立足于我国实际启动宪法解释程序的制度保障。人民代表大会制度为设计宪法解释启动机制提供制度依据,确保宪法解释启动主体的普遍性,有助于宪法解释的启动有效发挥功能。完善宪法解释启动机制要针对现实中存在的问题,对相关体制和机制加以完善。为此,应当完善受理宪法解释启动申请的体制和条件,完善国家机关违宪审查要求权的实施机制,完善其他国家机关和社会团体、企业事业组织以及公民违宪审查建议的处理程序。
The key to improve the procedure mechanism of constitutional interpretation is the perfection of the initiation procedure of constitutional interpretation. While the theory of ＂people are the masters of the country ＂ is the theoretical base on which we explore the approach to initiate the constitutional interpretation procedure,the system of people ＇s congress is the system guarantee for the initiation of constitutional interpretation procedure according to national situations. The system of people ＇s congress ensures the universality of the subject initiating the constitutional interpretation procedure, the normalization of the initiation of constitutional interpretation procedure and it can serve the initiation procedure of constitutional interpretation to function well. The initiation of constitutional interpretation procedure needs to take the theory of people are the masters of the country ＇ as the theoretical base and the system of people＇s congress as the system guarantee on the one hand,and it needs to improve the concerned system and mechanism in the light of the existing problems on the other. Therefore,the institution and mechanism concerning handling with the application for the initiating procedure of constitutional interpretation shall be improved; the state organ ＇s right to apply for constitutional review shall be reinforced; the enforcement procedure of other state organ,social entity,enterprise and institution as well as citizen ＇s right to raise the suggestion of constitutional review shall be further normalized.
