摘要
农村宅基地的闲置或低效利用造成了土地资源的浪费和土地利用效益的降低,必须采取一定的措施将其退出。根据国外发展权转移制度的理论与实践,在我国创设宅基地发展权能够为宅基地退出提供良好的动力机制,并且有利于优化宅基地退出中的利益分配格局。根据国外发展权制度的本质和功能,并结合我国宅基地退出的具体情况,探索了宅基地发展权的定义和本质、宅基地发展权创设的必要性和可行性、宅基地发展权的归属、功能、定价和交易等基本问题,以期为宅基地发展权制度的构建打下理论基础。
The idleness or inefficient use of rural residential land results in the waste of land resources and decrease of land use efficiency. Therefore, some measures have to be taken form the withdrawal system of rural residential land. According to the theories and practices of transferable development rights system abroad, the establishment of the development rights of rural residential land can effectively promote to the withdrawal of rural residential land, and it can optimize the interest distribution pattern in the process of exiting rural residential land in China. Drawing on experience from the natures and functions of transferable development rights system' and combining with the concrete conditions of withdrawal of rural residential land in our country, the paper explored some basic theoretical issues of the developing rights of rural residential land:the definition and nature of the development rights of rural residential land, the necessity and feasibility of creating the development rights of rural residential land, and the attribution, functions, valuation and transaction of the development rights of rural residential land. Furthermore,this study could provide the base for the construction of the development rights system of rural residential land.
