摘要
宅基地"三权分置"改革成效直接关系到乡村振兴战略目标能否实现的重要问题。本文站在历史的视角,通过梳理和总结新中国成立后宅基地制度相关文件,运用对比分析的方法发现我国宅基地演进的过程可以看作是政治偏好与经济偏好相互博弈的过程,突出表现为产权权能的细化、产权强度的适应性及使用权主体范围的扩大与缩小。进而通过理论分析与文献分析法指出我国宅基地制度变迁方式逐渐由强制性向诱致性转变,并从土地价值、利用效率、制度变迁成本三个方面分析改革的经济动力,从社会稳定、城乡统筹、乡土社会三个方面分析改革的社会政治动力。我国宅基地"三权分置"改革也应该从经济、社会政治与农民个体目标三个层面探寻改革路径,其三个方面的价值与作用也同乡村振兴战略的总要求相契合。
The effect of ＂three rights separation＂ reform is directly related to the realization of rural area revitalization strategy. The process of homestead evolution can be regarded as the process of game between political preference and economic preference by combing and summarizing the relevant documents of the homestead system after the founding of New China. It is characterized by the property right subdivision, the adaptability of the strength of property rights as well as the enlargement and narrowing of the scope of the users. Then through the method of theory analysis and document analysis it is turned out that the way of the institutional transition of the homestead in China gradually changes from the compulsory system to the causative system. Furthermore, there are two aspects of internal driving force for the reform of the homestead ： economic force and social and political force. Economic force can be analyzed from the value of the land, utilization efficiency and transaction costs. While the social and political force can be analyzed from social stability, rural and urban development and the features of Chinese local society. The path of the ＂three rights separation＂ reform should be explored from three aspects： economy, social politics, peasantg individual goals. And so does the reform＇ s value and function in accord with the general requirement of rural revitalization strategy.
