摘要
基层政府侵害农民的宅基地现象的发生,除了现行法律制度对基层政府宅基地征收权的规制存在缺失的原因外,政府垄断宅基地发展权、基层民主运行不畅等也是重要因素。对基层政府侵害农民宅基地的行为应予以综合规制。应完善现行的规制方式,明确公共利益的范围、保障农民的知情权和参与权、消解农民救济权的行使障碍。同时,在立法上赋予农民集体宅基地的发展权,充实基层民主。
In recent years,local governments tend to trespass farmers＇homestead land in various names. Besidesthe lack of the current legal system regulating the power of the local governments related to homestead land expro-priation,the emergence of this phenomenon is also owing to such important elements as the governmental monopo-ly power in homestead land development and the unsound running of grassroots democracy. It is necessary to bringunder control the acts infringing farmers＇homestead land by local governments in a comprehensive way. The mostimportant thing is to consummate the ways of present regulation and controls,clarify the range of the public bene-fits,protect farmers＇right to know and right to participate and remove the obstacle to the exercise of remedial andrelief right on the part of farmers. Meanwhile,it is essential to authorize peasants with right to developing home-stead land and upgrading grassroots democracy.
