摘要
裁判的法律效力是审判机关作出的确定裁判所产生的诉讼法上的效果。明确实现担保物权非讼许可裁定的效力问题,是该裁定能够得以快速、正当、高效执行的基础。实现担保物权非讼许可裁定对人民法院具有拘束力,是审判权得以实现的保障。实现担保物权非讼许可裁定作为终局裁定,具有形式确定力。准予拍卖、变卖担保财产的实现担保物权非讼许可裁定具有给付内容,产生执行力。实现担保物权非讼许可裁定能够变更担保财产在实体法上的法律关系,具有形成力。实现担保物权案件的非讼性特征及非讼程序设置的简略性,使得实现担保物权非讼许可裁定无既判力产生的根据。
Referee legal effect is to determine the effect of procedural law arising from the referee to make the judiciary. To ensure the non-litigation license ruling of realizing security interest is the foundation of the determination being executed quickly,legitimately and efficiently. It is binding to the People's Court,which is to protect the trial implementation. As a final ruling,it has a form determined force. Disapproving the auction,sale of secured property licensing ruling has paid content,resulting in execution. The secured property legal relations can be changed in the substantive law,with the formation of the force. The realization of non-litigation features and the simplicity of non-litigation procedure make the license have no judicata basis.
