摘要
要做到既保障不妨碍涉罪未成年人诉讼的顺利进行,又通过少羁押实现对未成年人的特殊保护,其核心在于提高非羁押性强制措施对于涉罪未成年人的适用效能。为了准确把握对涉罪未成年人适用非羁押性强制措施的尺度,应当运用科学的评估方法,综合分析预测可能出现的诉讼风险,并针对不同的诉讼风险采取相应的防范控制措施。
How to protect juvenile criminals and ensure the achievements of litigation, while protecting the juveniles by reducing the behaviors of detainment？ The core measure is to be more efficient when we use non-costidal compulsory measures to the juvenile criminals.In order to average out this measure, we need scientific assessment, reasonable prediction techniques of the litigation risk. What＇s more, take different measures to deal with various risks.
