摘要
公共行政责任与道德、伦理息息相关,有其独特的价值内涵和价值目标。本文以责任政府、服务型政府建设为基本背景,考量公共行政责任的内在价值指涉:一是其伦理规范价值,要求公权力的行使必须符合既定的行政伦理规范要求,代表社会的公共利益;二是其德性价值目标,即要求公共行政主体通过德性之内化及行政德性人格之塑造消解具体管理情景下的行政选择冲突和价值冲突;三是其正义诉求,即公共行政及其主体必须尊重和维护公民权利,促进社会公平和正义的实现。最后,从对公共行政责任如何实现的探讨出发,提出伦理规范与道德德性并重,从规范到德性的逻辑路径。
Public administrative responsibility has its unique value connotation and target, which is closely related with morality and ethics. Based on the construction of reponsibility government and service government,this paper finds the intrinsic value of public ad- ministrative responsibility：one is ethical norm value. The exercise of public power must abide by the established administrative ethical norm on behalf of social public interests; The second is the moral value. The purpose is to dispel concrete management of the admin- istrative choice conflict and value conflict by internalization of morality and personality from public administrative subjects;The third is to appeal to justice which means that public administration must respect and safeguard civil rights, and promote the realization of so- cial fairness and justice. Finally, with the realization of public administrative responsibility, it is discussed that ethics and moral virtue play the same important rote and provide logic way from norm rules to the formation of virtues.
