摘要
应急决策在公共危机管理中处于核心地位并发挥着重要作用。为了舒缓应急决策的实质正当性与形式合法性之间的紧张关系,必须对应急决策进行更为具体的制度定位,这一定位应当从理念和实施层面切入。在应急决策制度化的过程中,需要法律提供具体的保障机制,主要包括适用于决策实施的特殊授权机制、程序缩减和补办机制、决策行为的事后追认机制、决策者的责任豁免机制。
The emergency decision-making is at the core position in public crisis management due to its important functions. In order to resolve the strained relations from substantial justice and formal legitimacy, we should make a more specific systemic positioning for emergency decision-making from the perspectives of concept and implementation. In the institutionalization of emergency decision-making, legal protection should be provided, mainly including the mechanism for special authorization, the mechanism for altering procedure, the mechanism for the subsequent ratification, and the mechanism for the exemption from liability of the decision maker.
