摘要
从行政法角度对《城市规划法》和《城乡规划法》中规划许可的特征进行比较分析,提出规划许可制度已经从《城市规划法》的详细规划为导向的"自由裁量"许可体系,转向《城乡规划法》中的控制性详细规划作为"严格规则"的许可体系,从循序渐进的多次决策转向了以规划条件为核心的一次决策体系。并就受规划许可制度转型影响的控制性详细规划、规划许可程序及规划许可作用等三个问题进行了探讨。
The paper first compares the characteristics of planning permission in the Urban Planning Act and the Urban and Rural Planning Act from the perspective of administrative law, and then suggests that the permission system has changed from detail planning-oriented discretionary mode as prescribed in the Urban Planning Act to the mode that takes regulatory planning as strict rules as described in the Urban and Rural Planning Act, as well as from the mode of incremental decision in the permission process to the mode of one-time decision by the offer of planning conditions. The paper also explores the issues related to regulatory planning, permission process and permission role, which are influenced by the transition of planning permission system.
