摘要
规划许可制度是规划管理制度体系的重要组成部分。当前中央提出用地审批"放权",这必然需要规划许可制度的改革响应。在此背景下,文章从规划许可切入,通过梳理新中国成立以来规划许可制度的演变历程,结合同时期规划体系及土地管理制度,探讨规划许可制度的内在演变逻辑,并在总结我国规划许可制度阶段性困境的基础上,从制度体系、许可程序和监管机制3个方面提出规划许可制度的改革路径,以期为用地审批"放权"下的规划许可制度改革提供思路。
The planning permission system is an important part of the planning management system,and it needs to respond to national requirement of decentralization of power.With a review of the evolution of the planning permission system since the founding of the PRC,the paper explores the internal evolution logic of the planning permission system in consideration with current land management system.Based on a conclusion of the staged difficulties of China’s planning permission system,the reform path of the planning permission system is proposed from three aspects:perfecting the system,optimizing the permission procedure,and strengthening the supervision mechanism.It is expected to provide ideas for the reform of planning permission system under the land use approval and decentralization.
