摘要
马克思主义法学是具有科学性、人民性、实践性和开放性的法学理论体系。马克思主义法学的科学性奠基于马思主义科学理论体系中,并且是一个不断丰富、发展和完善的法学理论体系。马克思主义法学坚持人民的主体地位,强调法律的阶级性并始终秉承服务于人民的阶级立场,坚持以人民利益为根本出发点和判断标准。马克思主义法学不是教条,而是高度包容和开放,不断发展和创新的理论体系。马克思主义法学的开放性和中国化,使得马克思主义法学对中国法治具有更强的解释力、批判力、回应力和引导力,理论更具生命力和科学性。在全面依法治国进程中,必须始终坚持马克思主义法学的指导地位,在此基础上,合理吸纳人类法治文明发展的最新成果。
Marxist jurisprudence is a scientific,popular,practical and open legal theory system. The scientific nature of Marxist jurisprudence is based on the scientific theory system of Marxism,and it is a legal theory system that is constantly enriched,developed and improved. Marxist jurisprudence upholds the principal status of the people,emphasizes the class nature of the law and always upholds the class position which is serving the people. Marxist jurisprudence is not a doctrine,but a highly inclusive,open,developing and innovative theoretical system. The openness and Sinicization of Marxist jurisprudence make Marxist jurisprudence have stronger explanatory power,critical power,responsiveness and guiding power for the rule of law in China. In the process of comprehensively ruling the country according to law,we must always adhere to the guiding status of Marxist jurisprudence,on this basis,reasonably absorb the latest achievements of the development of human civilization under the rule of law.
