摘要
业主对区分所有建筑物共有部分的共有权是建筑物区分所有权的组成部分。业主的共同权益要得到切实维护,必须确保业主共同权益侵害者受到追究。物业服务企业作为行使诉权追究业主共同权益侵害者责任的主体,是最为现实和可行的选择,为此需要建立相关机制促进物业服务企业正确行使诉权。
Ownership over the common parts of the buildings is one part of condominium ownership. To protect common interests of condominium owners, the persons who injured such common interests should be sued. The most realistic choice is giving legal position to the real property management enterprises. Therefore, the system should be established to ensure the suing rights of property management enterprises.
