摘要
工伤保险制度作为最普遍和悠久的社会保障项目之一,其产生与发展有着深刻的动力机制:生产力的进步是根本动因,公平与效率之争、利益集团的博弈则是内在动力。以此为着眼点将能更好地解读该制度演进中所经历的不同阶段和特点,即法律依据由侵权行为法向社会法的跨越,组织形式由自发的工人互助保险组织向统一的工伤社会保险制度的过渡,以及制度内容由"赔偿"向更高层次上的"补偿"的演变。
Modem occupational injury insurance, as one of the most universal and old items of social security, has its fundamental motivation in its emergence and development. With the progress of productive forces as the internal cause, the dispute of equity and efficiency, and the fight between different interest groups are internal motivation. Accordingly, its history can be interpreted from three aspects. Legal basis moves fi＇om tort law to social law. Organizational forms transitted from workers mutual insurance organization to a unified social occupational injuriy insurance system, as well as the evolution of treatment to a higher level of ＂compensation＂
