摘要
《劳动合同法》颁布以来,社会各界都关注这部法律,对该法的评价亦是非纷纭,莫衷一是,甚至存在诸多极端的负面评价。任何一部法律皆有漏洞,任何法律如同药方,食药皆有副作用,但不能讳疾忌医。《劳动合同法》需要客观评价,发挥其解雇保护功能。
The PRC Labor Contract Law has aroused great attention from all walks of life since its promulgation. Simultaneously, there have been many controversial opinions concerning the Law, with no unanimous conclusion drawn from it and even with many extremely negative opinions included. Any law may have shortcomings and flaws and then cause side effects just like a medical prescription, and therefore it is unwise to refuse to face up to its problems. However, the positive effect of the law should not be ignored and needs to be objectively evaluated to bring into full play the protective function for discharging.
