摘要
对中美职业教育立法的比较显示:美国职业教育立法呈现较为明显的同步性、可操作性、制约性、客观性和科学性,而我国职教立法理论的研究滞后于实践的需要,对国家、社会和企业各自应承担的责任和义务没有作出明确规定,缺乏实证研究的支持。为此,我国应加强高职教育立法的理论研究与学科建设,变政策为法令,增强职教法规约束力,及时出台配套政策和实施细则,健全、完善教育执法与监督机制,适应社会发展,及时修订职业教育法律。
Comparing vocational education legislation between China and America show that; America vocational education legislation manifest more characteristics of synchronization, operatability, conditionality and scientificity; the theoretical study on vocational education legislation in China lags behind the demand of practice, relative legislation on vocational education don't have definite regulation for responsibilities and obligations for society and enterprise and lack the support of empirical study. Therefore, China should strengthen theoretical study and subject construction of vocational education legislation, transform policy into statute, strengthen the sanction of vocational education legislation, issue equipped policies and detailed implementation rules, optimize mechanism for executing law and monitoring, emending vocational education law in time to adapt to social development.
