摘要
契约精神不仅蕴藏着自由合意、权责对等、互助公益等方面的内涵,而且对社会关系的调节具有法律和道德所不具备的特点与功能。在社会转型期,合理引进和倡导契约精神,对于化解社会矛盾、构建和谐社会,具有重要的现实意义。
The spirit of contract involves free consensus, power--responsibility equivalence, mutual help and shared benefit and so on. It also has the characteristics and function of adjusting social relations in a way that law and moral dodes cannot. In the social transitional period, proper introduction and promotion of the spirit of contract is of great importance and realistic significance in resolving social contradictions and in building a harmonious society.
