法律应适合侦控犯罪的实际水平和现实需要。侦查自由度与其程序规制性之间是有冲突的,这就需要建立适合于侦控规律的法制体系,研究合法用谋的原则技巧,在谋略性与法律性之间架起充分发挥案侦人员智慧的桥梁。
The law should be perfect for investigating to solve to commit crime and to control crime, It is eonflictive between the freedom of investigation and the limit of working procedure. Therefore, we need to build the legal system and study the legal skills in principle in order to put up a bridge between the strategy and legal character of criminal investigation.
